INTENDED FORFEITURE

And all others claiming an interest in the above-described property.
You are hereby notified that the State of Oklahoma has seized and intends to forfeit the following described currency:
ONE HUNDRED NINETY
THOUSAND NINE HUNDRED FIFTY-EIGHT DOLLARS ($190,958.00) IN U.S.
CURRENCY
Upon information and belief, it is alleged as follows:
It is alleged that the above-listed currency, which was seized by OBN agents in McClain County, Oklahoma, on or about the 30th day of April 2026, was furnished or intended to be furnished in exchange for a controlled dangerous substance in violation of the Uniform Controlled Dangerous Substances Act (UCDSA) and/or was proceeds from such exchange, and/or was used or intended to be used to facilitate a violation of the UCDSA. Said currency was also acquired during a period of a violation of the UCDSA or within a reasonable time after such period and there is no likely source for such property or thing of value other than the violation of the UCDSA. Said currency was in close proximity to forfeitable drug distribution paraphernalia. Said currency is thus forfeitable pursuant to 63 O.S. §2–503(A)(6), (7), and/or (B).
On April 30, 2026, an OBN agent attempted to conducted a traffic stop on a vehicle in McClain County for a traffic violation. The two occupants of the vehicle attempted to elude the agent in their vehicle, which led to a pursuit into the City of Purcell. During the pursuit, the passenger of the vehicle exited the car with a backpack containing the Defendant Currency and attempted to flee on foot. The passenger was subsequently located and detained by McClain County deputies as the passenger attempted to book a room to hide at the Econo-Lodge Inn in Purcell. The passenger had left the backpack containing the Defendant Currency in an alley behind the Econo-Lodge Inn where another deputy located the backpack. A deputy handed the unopened backpack to the OBN agent who immediately noticed the odor of marijuana emanating from the backpack, which indicated the presence of narcotics to the agent. Based on probable cause, the agent searched the backpack and located the Defendant Currency, which was bundled in a manner consistent with being proceeds of illegal drug transactions or facilitating illegal drug transactions.
At another location in Purcell, a Purcell police officer located the abandoned vehicle used in the attempted eluding along with the driver who was attempting to hide in some bushes. The OBN agent went to the location of the abandoned vehicle and noticed the odor of marijuana emanating from the vehicle. During a subsequent probable cause search of the vehicle, agents located six large empty duffel bags, which, based on the agents’ training and experience, they believed were intended to be used to illegally transport large quantities of marijuana for illegal distribution and trafficking and had been near the Defendant Currence prior to the passenger’s attempt to flee on foot from the pursuit. Agents also located what they believed to be marijuana shake. A subsequent test of the Defendant Currency resulted in a positive test for the presence of marijuana on the currency. Based on the currency’s association with black market marijuana trafficking, and other relevant factors and considerations, in the opinion of the agents, the Defendant Currency is subject to forfeiture.
Further notice is hereby given that within forty-five (45) days after receiving this Notice, the owner, claimant or other party in interest may file a verified answer and claim to said property. Said answer, if filed, is to be filed with the Court Clerk and a copy must be mailed to the office of the OBN General Counsel, 419 N.E 38th Terrace, Oklahoma City, Oklahoma 73105. At the end of forty-five (45) days and if no answer is filed, the State will move the Court for an Order of Forfeiture to the state of Oklahoma based upon evidence upon the facts of the unlawful use of the above-described property in compliance with 63 O.S. §§ 2–503 and 2–506.
