ON PETITION TO ADMIT
FOREIGN PROBATE,
DETERMINE DEVISEE, AND DISTRIBUTE OKLAHOMA
MINERAL INTERESTS
PURSUANT TO 58 O.S. § 677, OR IN THE ALTERNATIVE, FOR SUMMARY ANCILLARY
ADMINISTRATION
COMES NOW for consideration the Petition to Admit Foreign Probate, Determine Devisee, and Distribute Oklahoma Mineral Interests Pursuant to 58 O.S. § 677, or in the Alternative, for Summary Ancillary Administration, filed by Turner Cornell Mooneyham, Independent Executor of the Estate of Mary Ruth Brush, deceased, and the Court finds that said Petition should be set for hearing and that notice should be given as required by law.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that said Petition is hereby set for hearing before this Court at the McClain County Courthouse, Purcell, Oklahoma, on the 16th day of July, 2026, at 9:30 a.m., or as soon thereafter as the matter may be heard.
IT IS FURTHER ORDERED that notice of the hearing shall be published one (1) time in a newspaper of general circulation in McClain County, Oklahoma, not less than twenty (20) days prior to the date of hearing.
IT IS FURTHER ORDERED that notice of the hearing shall be mailed to all devisees, legatees, and heirs at law of the Decedent, including those named in the Last Will and Testament or otherwise known to Petitioner, not less than twenty (20) days prior to the date of hearing. If the address of any devisee, legatee, or heir at law is not known, publication of this Notice shall constitute notice to such person or entity.
NOTICE IS HEREBY GIVEN to all heirs, devisees, legatees, creditors, and persons interested in the Estate of Mary Ruth Brush, deceased, that Turner Cornell Mooneyham has filed in this Court a Petition to Admit Foreign Probate, Determine Devisee, and Distribute Oklahoma Mineral Interests Pursuant to 58 O.S. § 677, or in the Alternative, for Summary Ancillary Administration.
The Petition alleges that Mary Ruth Brush died testate as a nonresident of the State of Oklahoma; that her Last Will and Testament was admitted to probate in the domiciliary probate proceeding; that Turner Cornell Mooneyham is the duly appointed and acting Independent Executor; that the Decedent owned Oklahoma mineral interests, including mineral interests located in McClain County, Oklahoma; and that Turner Cornell Mooneyham is the person entitled to distribution of the Oklahoma mineral interests pursuant to the admitted Last Will and Testament.
The Petition requests that the Court recognize the foreign probate proceedings, determine the person entitled to receive the Oklahoma mineral interests, and enter an order distributing the Oklahoma mineral interests described in the Petition and attached exhibit to Turner Cornell Mooneyham pursuant to 58 O.S. § 677. In the alternative, if the Court determines that direct distribution under 58 O.S. § 677 is not appropriate, the Petition requests that the Court proceed by summary ancillary administration or grant such other relief as may be proper under Oklahoma law.
Any interested party or creditor may appear at the hearing and show cause, if any there be, why the relief requested in the Petition should not be granted. Any interested party or creditor who objects to the entry of an order distributing Oklahoma property must file a written objection on or before the hearing date, as provided by 58 O.S. § 677.
