ORDINANCE NO. 26-01

AN ORDINANCE OF THE

CITY OF PURCELL,

OKLAHOMA, CLOSING TO PUBLIC USE A CERTAIN ROADWAY/ALLEYWAY (N 9TH AVE.) AS MORE PARTICULARLY HEREINAFTER DESCRIBED, LOCATED IN THE CITY OF PURCELL, MCCLAIN COUNTY, OKLAHOMA. 

WHEREAS, pursuant to an application to close a portion of N 9th Ave. described below, made by the Housing Authority of the Chickasaw Nation, owners of a part of Lots 3&4, Block 63, City of Purcell; and 

WHEREAS, the closing of said portion of N 9th Ave. does not remove the ability of the City of Purcell, Purcell Public Works Authority, or franchise holders from using said roadway/alley for any utility purpose; and 

WHEREAS, the Purcell Planning Commission held a public hearing on November 17, 2025, and found that the closing of said portion of N 9th Ave. will not adversely affect the health, safety, or general welfare of the public and therefore recommend closure; and 

WHEREAS, in accordance with 11 O.S. § 42-110(B), a notice was published in the Purcell Register on November 20, 2025.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PURCELL, OKLAHOMA:

SECTION I:

The portion of N 9th Ave. that abuts Lot 4, Block 63, City of Purcell, and more particularly described as the East Twenty (20) feet of the West Forty (40) feet of that portion of N 9th Ave. between W Jefferson Street and W Jackson Street, in the City of Purcell, McClain County, Oklahoma; dedicated to the public as an alley or roadway by Ordinance No. 595 enacted on November 23, 1956 shall be closed to public use.

SECTION II 

The City of Purcell shall retain the absolute right to reopen said alley without expense to the municipality.  The closing of said alley shall not affect the right to maintain, repair, reconstruct, operate, install, or remove any utility, public service corporation, or transmission company facilities of service therein, nor shall a closing affect private ways existing by operation of law unless released in writing by the owners thereof.  (11 O.S.§ 42-110)

The City Council of the City of Purcell, Oklahoma, finds that more than thirty (30) days prior to the consideration of this Ordinance, written notice was given to those entities having a special right or privilege granted by Ordinance or legislation enacted to use the public way located within the boundaries of the hereinbefore described property located within the boundaries of the City of Purcell, McClain County, Oklahoma.

SECTION III: SEVERABILITY.  

If any section, subsection, sentence, clause, or phrase of these Ordinances are, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of these Ordinances.  

SECTION IV: REPEALER.  

All other Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
