RESOLUTION NO. 26-P03

A RESOLUTION OF THE PURCELL PUBLIC WORKS AUTHORITY PROVIDING FOR A TEMPORARY 10% INCREASE OF THE CURRENT RATES NOW IN FORCE AND EFFECT FOR THE COLLECTION AND DISPOSAL OF RESIDENTIAL AND COMMERCIAL SOLID WASTE AS HEREINAFTER SET FORTH FOR ONE HUNDRED TWENTY (120) DAYS.  

WHEREAS, the Trustees of the Purcell Public Works Authority (“Authority”) on behalf of its sole Beneficiary, the City of Purcell, are charged with the duty and responsibility of establishing rates for services rendered through the solid waste collection; and

WHEREAS, in accordance with paragraph 10.b of the contract with GFL, it will implement a fuel surcharge to the Service Fee when fuel charges for diesel are above the threshold price of $3.50 per gallon; and 

WHEREAS, GFL has implemented a 10% fuel surcharge which shall be effective beginning July 1, 2026 and shall remain in effect for one hundred twenty (120) days; 

WHEREAS, the Trustees deem it necessary to increase the solid waste charge to customers by 10% to cover the increase; 

WHEREAS, the temporary increase will be reevaluated in one hundred twenty (120) days;  

NOW, THEREFORE, BE IT RESOLVED BY THE TRUSTEES OF THE PURCELL PUBLIC WORKS AUTHORITY, PURCELL, OKLAHOMA, THAT:

Section1. The categories of service provided through the Authority and its Beneficiary, the City of Purcell shall be and remain those categories currently defined and set forth in the City Code of Ordinances of the City of Purcell.

Section 2. From and after July 1, 2026 the monthly rates for collection and disposal of solid waste shall be as follows:

GARBAGE COLLECTION AND DISPOSAL RATES:

Section 3. The temporary 10% increase referenced herein shall automatically expire 121 days from July 1, 2026 unless extended or otherwise modified by the Public Works Authority.

Section 4. The provisions in Purcell Code of Ordinances, currently in force and effect providing for collection of fees, late payment and penalties and sanctions for nonpayment for the aforesaid service shall remain in effect except as herein modified.

Section 5. All resolutions or parts of resolutions, and all ordinances or parts of ordinances, in conflict herewith, are hereby rescinded, or repealed.

Section 5. The above rates shall be effective as approved by the Trustees.
