ORDINANCE  NO. 26-09

AN ORDINANCE OF THE CITY OF PURCELL, OKLAHOMA REPLACING AND AMENDING CHAPTER 110 (UTILITIES) SECTION 110-216 (CONVENIENCE CENTER POLICIES) OF THE PURCELL CODE OF ORDINANCES GOVERNING THE PURCELL CONVENIENCE CENTER; AND PROVIDING FOR REPEALER.

WHEREAS, the City of Purcell is a municipality governed by the laws of the State of Oklahoma; and

WHEREAS, the City Council of the City of Purcell desires to provide and operate for residential customers of the City of Purcell a Convenience Center; and

WHEREAS, the City Council desires to establish rules and regulations for the use of the Convenience Center;

NOW, THEREFORE, BE IT ORDINAED BY THE CITY COUNCIL OF THE CITY OF PURCELL, OKLAHOMA:

Section 1. Amendment. Section 110-216 of the City of Purcell Code of Ordinances is hereby amended to read in its entirety as follows:

  1. Hours of Operation. Hours of operation for the City of Purcell Convenience Center shall be as follows:
  2. Sunday and Monday: CLOSED
  3. Tuesday through Friday: 12:30 PM – 5:30 PM

iii. Saturday: 10:00 AM – 4:00 PM

  1. All loads must be finished unloading at the end of the hours of operation.
  2. The Center will not be available on established holidays. The City Manager shall have the authority to set or change the hours of operation or close the Center at any time the Center is not available to process/store items and/or due to weather conditions, seasonal operation, or any other unforeseen circumstances.
  3. Fees. Fees assessed for all vehicles dumping at the City of Purcell Convenience Center shall initially be set as follows:
  4. Vehicles:
  5. Any Vehicle not exceeding One (1) ton truck rating. $10.00
  6. Any vehicle exceeding one (1) ton truck rating but not exceeding two (2) ton truck rating. $50.00
  7. No box trucks or vehicles which exceed two (2) tons truck rating will be permitted to dump.
  8. Trailers:
  9. Trailers up to twelve feet (12’) in length. $10.00
  10. Trailers between thirteen feet (13’) to eighteen feet (18’) in length. $20.00
  11. Trailers exceeding twenty feet (20’) in length. $35.00
  12. All other dump trailers. $50.00
  13. Mattress or box spring.  $10.00/per 

iii. The City Council shall have the authority to set or change fees at any time by resolution.

  1. Purpose. The convenience center is provided and operated for residential and commercial trash customers.
  2. Deposits. Items are to be deposited into appropriately designated containers as marked and/or directed by the City’s representative(s). For example, only brush-tree limbs will be accepted at the “grinder” and only metal products at the designated “metal” container. Failure to deposit items at designated locations may result in a special assessment being imposed.
  3. Accepted Items. The following items will be accepted for dumping at the Purcell Convenience Center, unless otherwise stated:
  4. Furniture and miscellaneous household items.
  5. Appliances, but appliances such as refrigeration and air conditioning units must have compressors removed.
  6. Items that will not fit into polycarts or dumpsters, which are not otherwise prohibited.
  7. Bricks, rock, dirt, concrete, and metal, but only in designated locations.
  8. Unaccepted Items. The following items will not be accepted for dumping at the Purcell Convenience Center:
  9. Any item too large to fit within a designated container and/or restricted by ODEQ or the EPA. 
  10. All hazardous items, including but not limited to toxic chemicals or materials, asbestos, acids, and batteries.
  11. Paint, lacquer, thinner, solvents, motor oil, anti-freeze, and similar products.
  12. All rubber products, including tires and tubes.
  13. Any household trash or garbage.
  14. All construction debris, including but not limited to, shingles, sheetrock, etc., but not including any construction material accepted under (E).
  15. Policies. The following policies are hereby adopted and enforced regarding the use of the Purcell Convenience Center for dumping:
  16. A copy of the current month’s utility statements showing trash service and a photo identification must be presented at time of dumping.
  17. Use of false identification or using another customer’s account may result in suspension of the right to dump at the Purcell Convenience Center.  Failure to deposit items at designated locations may result in a special assessment being imposed and/or suspension of the right to dump at the Purcell Convenience Center.
  18. Commercial Dumping Prohibited. The City of Purcell Convenience Center is open to commercial customers of the City of Purcell; however, all commercial dumping is hereby prohibited. Commercial dumping, for purposes of this section, is defined as “any dumping by any individual or entity who is paid, reimbursed, or otherwise compensated for hauling off and/or dumping garbage, debris, or other items.” 
  19. Disclaimer. The City of Purcell and its agents are not responsible for any accidents or injuries related to the unloading of items at the Convenience Center and are not responsible for items lost, destroyed or stolen at the Center. The City will not assist and/or furnish equipment or employees for unloading items.

Section 2. Repealer. All other ordinances or parts of ordinances including resolutions we need to add resolutions here also since in conflict herewith are hereby repealed.

Section 3.  Severability. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance.  The City Council of the City of Purcell hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
