ORDINANCE NO. 26-03
AN ORDINANCE OF
THE CITY OF PURCELL AMENDING CHAPTER 10 (ANIMALS), ARTICLE 10-7 (ANIMALS AT LARGE; ANIMAL SHELTER) BY INSERTING
SECTION 10-288
(DISPOSITION OF ANIMALS UPON ARREST); REPEALING ALL OTHER CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PURCELL, OKLAHOMA:
Chapter 10, Article 10-7 of the Purcell Municipal Code of Ordinances is amended to include Section 10-288, which shall hereafter read as follows:
SECTION I: AMENDMENTS.
Section 10-288 Disposition of Animals Upon Arrest
Any individual owning an animal or animals located within the City of Purcell, Oklahoma who is subject to arrest shall, within ten (10) days of such arrest, make arrangements for such animal(s) to be taken into the care and custody of an individual or organization with full power and authority to retrieve such animal(s) from the custody of the Purcell Animal Shelter, if they are within the custody of the Purcell Animal Shelter, paying all costs incurred thereby, and to ensure the animal is thereafter kept in accordance with the provisions of this Chapter. Failure of the arrested individual to make such arrangements shall result in the animal(s) being deemed abandoned and subject to the provisions of Section 10-285 regarding disposition of such animal(s).
SECTION II: SEVERABILITY.
If any section, subsection, sentence, clause, or phrase of these Ordinances are, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of these Ordinances.
SECTION III: REPEALER.
All other Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
