ORDINANCE NO. 26-02

AN ORDINANCE OF THE CITY OF PURCELL, OKLAHOMA, ADOPTING THE LATEST OF ALL SUBSEQUENT EDITIONS OF THE NATIONAL ELECTRICAL CODE, INTERNATIONAL BUILDING CODE, INTERNATIONAL EXISTING BUILDING CODE, INTERNATIONAL RESIDENTIAL CODE, INTERNATIONAL FIRE CODE, INTERNATIONAL FUEL GAS CODE, INTERNATIONAL PLUMBING CODE, THE INTERNATIONAL MECHANICAL CODE, AND THE INTERNATIONAL PROPERTY MAINTENANCE CODE, UNLESS SPECIFICALLY NOT ADOPTED BY THE CITY OF PURCELL; AND REPEALING ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY.

Preamble: The City of Purcell previously adopted editions of the International Building Code, the International Existing Building Code, the International Residential Code, the lnternational Fire Code, the International Fuel Gas Code, the International Plumbing Code, the lnternational Mechanical Code, the International Property Maintenance Code, and the National Electrical Code. However, the model codes, created by the International Code Council (ICC) and the National Fire Protection Association (NFPA), are modified from time to time, most commonly at a rate of every three (3) years.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PURCELL, OKLAHOMA:

SECTION I. ADOPTION

That these certain documents of which are kept on file in the office of the City Clerk of the City of Purcell, in accordance with the code of ordinances being marked and designated as follows:

The International Building Code,

The International Existing Building Code,

The International Residential Code,

The lnternational Fire Code,

The International Fuel Gas Code,

The International Plumbing Code,

The lnternational Mechanical Code,

The International Property Maintenance Code, and

The National Electrical Code.

Unless specifically excluded by the City of Purcell, which may be accomplished by ordinance, all editions of the International Code Council (ICC) and the National Fire Protection Association (NFPA), be and are hereby adopted, with the latest version published by the ICC and NFPA being maintained by the City Clerk and adopted for purposes of regulation, governance, and enforcement of the Building Code of the City of Purcell, in the State of Oklahoma.

SECTION II. OKLAHOMA UNIFORM BUILDING CODE COMMISSION

Pursuant to 59 O.S. Section 1000.23, the adoption of all Codes listed above includes the adoption of all modifications made by the Oklahoma Uniform Building Code Commission as set forth in title 748 of the Oklahoma Administrative Code.

SECTION III. EFFECT ON PROCEEDINGS

That nothing in this ordinance shall be construed to affect any previously adopted regulations concerning the issuance of permits and the collection of fees. That nothing in this ordinance or in the Existing Building Code hereby adopted shall be construed to affect any suit or proceedings pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section IV of this ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance.

SECTION IV. REPEALER

All other ordinances or parts of ordinances in conflict herewith are hereby repealed.

SECTION V. SEVERABILITY

That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Purcell hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
