LEGAL NOTICE

ACTION: Notice of decision to acquire land into trust under 25 Code of Federal Regulations, Part 151.

SUMMARY: The Superintendent, Bureau of Indian Affairs, U.S. Department of the Interior, on the

below date, has made a determination to acquire real property in trust for the Chickasaw Nation. The land referred to as former “Riverside Mining, LLC,” property, herein and is described as:

A triangular tract of land out of the Southwest Quarter of the Southwest Quarter (SW/4 SW/4) of Section 8, Township 7 North, Range 3 West of the Indian Base and Meridian, McClain County, State of Oklahoma, and described as follows, to-wit: Beginning at the Southwest corner of said Section 8; thence East along the section line to a point 940.5 feet East of the Southwest corner of said section; thence Northwesterly in a straight line to a point on the West line of said section which point is 603.9 feet North of the Southwest corner of said section; thence South along the section line to the point or place of beginning, according to the U.S. Government Survey thereof;

AND

The West Half of the Southeast Quarter (W/2 SE/4) and the South Half of the Northwest Quarter (S/2 NW/4) and a tract of land located in the Northwest Quarter of the Northeast Quarter (NW/4 NE/4) and the North Half of the Northwest Quarter (N/2 NW/4) described as follows: Beginning at the Northwest corner of said section; Thence south along the West section line to the Southwest corner of the Northwest Quarter of the Northwest Quarter; thence due East along the quarter section line to a point on the South line of the Northwest Quarter of the Northeast Quarter which Point is 313.5 feet East of the Southwest corner of the Northwest Quarter of the Northeast Quarter of said section; thence Northwesterly in a straight line to a point on the North line of said section which point is 940.5 feet east of the Northwest Corner of said section; thence west along the North line of said section to the point or place of beginning.

AND a strip of land in the Northeast Quarter of the Southeast Quarter (NE/4 SE/4) lying between two lines, the same being respectively 25 feet normally distant from and parallel with and each side of the center line of the main tract of the former Oklahoma Central Railroad Company's right-of-way, as relocated, across said Quarter section, said center line being more particularly described as follows: Beginning at a point on the East line of said quarter quarter section 458 feet South of the Northeast corner thereof; thence Northwesterly along a line having a Northwest angle of 81°50’21”; (previously noted of record as 81°37’) with East line of said quarter quarter section, a distance of 1337.5 feet to an intersection with the West line of said quarter quarter section at a point 271.2 feet South of the Northwest corner thereof, all in Section 17, Township 7 North, Range 3 West of the Indian Base and Meridian, McClain County, State of Oklahoma, according to the U.S. Government Survey thereof;

AND

The Southwest Quarter of the Northeast Quarter (SW/4 NE/4), LESS the following 3.98 acres, to-wit: A triangular tract of land in said SW/4 of the NE/4 described as follows, to-wit: Beginning at the Northeast corner of the SW/4 of the NE/4 of said Section; thence South along the East line of the SW/4 of the NE/4 a distance of 429.0 feet; thence in a Northwesterly direction to a point on the North line of the SW/4 of the NE/4 of said section which point is 808.5 feet West of the Northeast corner of the SW/4 of the NE/4; thence East along the North line of the SW/4 of the NE/4 to the Northeast corner thereof, being the point or place of beginning, in Section 17, Township 7 North, Range 3 West, McClain County, State of Oklahoma, according to the U.S. Government Survey thereof;

AND

The West Half of the Northwest Quarter of the Northeast Quarter (W/2 NW/4 NE/4) and the North Half of the Northeast Quarter of the Northwest Quarter of the Northeast Quarter (N/2 NE/4 NW/4 NE/4) of Section 20, Township 7 North, Range 3 West of the Indian Base and Meridian, McClain County, State of Oklahoma, according to the U.S. Government Survey thereof. Said tracts of land, when combined, contain an area of 12,551,173 square feet or 288.1353 acres, more or less.

Also being surveyed and described as follows:

A tract of land situated in part of the South Half of the Southwest Quarter (S/2 SW/4) of Section 8, Township 7 North, Range 3 West, and part of the Northwest Quarter (NW/4), part of the Northeast Quarter (NE/4) and part of the Southeast Quarter (SE/4) of Section 17, Township 7 North, Range 3 West, and part of the Northwest Quarter of the Northeast Quarter (NW/4 NE/4) of Section 20, Township 7 North, Range 3 West, I.M., McClain County, Oklahoma and being more particularly described as follows:

Basis of bearings are True North bearings with the West line of the NW/4 of Section 17, 7N-3W bearing N 00°31’06” W and monumented by a 3/8 inch rebar found at the NW corner and a 1/2 inch rebar with cap stamped LS 1298 Found at the SW corner of said NW/4; Beginning at a point on the West line of said S/2 SW/4 of Section 8, said point being 603.90 feet and N 00°15’35” W from the Southwest corner of said S/2 SW/4; Thence S 57°44’51” E a distance of 1,115.28 feet to a point on the South line of said S/2 SW/4, said point being 940.50 feet and N 89°28’07” E of the Northwest Corner of Section 17, T7N, R3W; Thence S 57°26’41” E a distance of 2,042.53 feet to a point on the East line of the NW/4 of Section 17; Thence continuing S 57°26’41” E a distance of 375.57 feet to a point on the North line of the Southwest Quarter of the Northeast Quarter (SW/4 NE/4) of Section 17; Thence N 89°27’07” E along said North line a distance of 203.39 feet; Thence S 62°41’05” E a distance of 917.89 feet to a point on the East line of said SW/4 NE/4 of Section 17; Thence S 00°56’45” E along said East line a distance of 891.03 feet to the Northeast corner of the West Half of the Southeast Quarter (W/2 SE/4) of Section 17; Thence S 00°47’51” E along the East line of said W/2 SE/4 a distance of 245.94 feet; Thence S 82°32’46” E a distance of 1,340.79 feet to a point on the East line of the Southeast Quarter (SE/4) of Section 17; Thence S 00°44’08” E along said east line a distance of 50.52 feet; Thence N 82°32’46” W a distance of 1,340.73 feet to a point on the East line of said W/2 SE/4 of Section 17; Thence S 00°47’51” E along the East line of said W/2 SE/4 a distance of 2,342.03 feet to the Southeast corner of said W/2 SE/4 of Section 17, also being the Northeast corner of the West Half of the Northeast Quarter (W/2 NE/4) of Section 20, T7N, R3W; Thence S 00°29’30” E along the East line of said W/2 NE/4 a distance of 330.52 feet; Thence S 89°23’48” W a distance of 662.27 feet; Thence S 00°29’30” E a distance of 991.69 feet; Thence S 89°23’11” W a distance of 662.27 feet to a point on the West line of said W/2 NE/4 of Section 20; Thence N 00°29’30” W along said West line a distance of 1,322.41 feet to a point on the North line of Section 20, said point being the Southwest corner of the West Half of the Southeast Quarter (W/2 SE/4) of Section 17, T7N, R3W; Thence N 00°51’33” W along the West line of said W/2 SE/4 a distance of 2,639.54 feet to the Northwest corner of said W/2 SE/4; Thence S 89°26’43” W along the South line of the Northwest Quarter (NW/4) of Section 17, T7N, R3W, a distance of 2,661.15 feet to the SW corner of said NW/4; Thence N 00°31’06” W along the West line of said NW/4 a distance of 2,641.39 feet to the Southwest corner of Section 8, T7N, R3W; Thence N 00°15’35” W along the West line of said Section 8, a distance of 603.90 feet to the place of beginning. Containing 288.135 acres more or less. SURFACE ONLY.

SUPPLEMENTARY INFORMATION: This notice is published to comply with the requirement of 25 CFR § 151.12(d)(2)(iii) that notice be given of the decision by the authorized representative of the Secretary of the Interior to acquire land in trust. A copy of the determination is available [from the office identified in the FOR FURTHER INFORMATION section of this notice]. This decision may be appealed by any person or entity who is adversely affected by the decision. Appeals must be submitted to the Regional Director, Eastern Oklahoma Region, Bureau of Indian Affairs at P.O. Box 8002, Muskogee, Oklahoma 74402-8002. The appeals process begins when you file with the reviewing official a notice of appeal, complying with the provisions of 25 CFR 2.205–2.207. 

Deadline for Appeal. Your notice of appeal must be submitted in accordance with the provisions of 25 CFR 2.214 within 30 days of the date you receive notice of this decision pursuant to 25 CFR 2.203. If you do not file a timely appeal, you will have failed to exhaust administrative remedies as required by 25 CFR part 2. If no appeal is timely filed, this decision will become effective at the expiration of the appeal period. No extension of time may be granted for filing a notice of appeal. 

Appeal Contents and Packaging. Your notice of appeal must comply with the requirements in 25 CFR 2.214. It must clearly identify the decision being appealed. If possible, attach a copy of this decision letter. The notice and the envelope in which it is mailed should be clearly labeled, “Notice of Appeal.” If electronic filing is available, “Notice of Appeal” must appear in the subject line of the email submission. Your notice of appeal must list the names and addresses of the interested parties known to you and certify that you have sent them and this office copies of the notice by any of the mechanisms permitted for transmitting the NOA to the BIA. 

Where to Send Copies of Your Appeal. In addition to sending your appeal to the Regional Director, Eastern Oklahoma Region, Bureau of Indian Affairs, you must send a copy of your appeal to this office at the address on the letterhead. 

Assistance. If you can establish that you are an enrolled member of a federally recognized Tribe and you are not represented by an attorney, you may, within 10 days of receipt of this decision, request assistance from this office in the preparation of your appeal. Our assistance is limited to serving your filings on the interested parties and allowing limited access to government records and other documents in the possession of this office. We cannot obtain an attorney for you or act as your attorney on the merits of the appeal.
