Checks were drawn on closed account

The owner of a Norman construction company has been charged in McClain County District Court with obtaining labor by bogus check.

An arrest warrant for Kenneth R. Breit, 46, is outstanding.

According to an affidavit, Chester Worley reported to the McClain County Sheriff’s Department that he had been doing concrete work for Breit  on 160th Street near Wayne.

Worley told investigators he had worked for Breit approximately six months.

In February, Breit paid him with two checks totaling $1,400. When Worley took the checks to McClain Bank, however, he learned they were written on a closed account at Northeast Missouri Regional Credit Union that had belonged to Breit’s deceased father, Fred Breit.

Worley contacted Kenneth Breit who said he would make good the checks. However, that never happened.

Fred Breit granted power of attorney over the account to his sister, also the account beneficiary, on Sept. 19, 2019.

Then on Oct. 28, 2019, the bank received durable power of attorney paperwork from Kenneth Breit. Three days later, Fred Breit died.

The account was closed Nov. 29, 2019, and the funds were paid to the sister.

Since then, according to the affidavit, Breit has continued to write checks on the closed account, resulting in cases in Noble and Purcell.
